Creation and Ownership

Who creates the artwork and designs sold by Castle Of Gifts?
The creative direction, visual concepts, compositions, patterns, characters, product prints and overall artistic identity of Castle Of Gifts are developed through Designora Studio under the direction of Sorina Constantin, a multidisciplinary artist and architectural, fashion, graphic and 3D designer.
The creative work is developed and art-directed through Designora Studio using professional digital-art, 3D and design tools, including AI-assisted tools where appropriate. Production partners may manufacture, print, embroider, assemble, pack or ship the physical products, but they do not become owners of the original creative material merely because they manufacture a product.
Who owns the copyrights?

Unless otherwise stated, copyright and other intellectual-property rights in original human-authored artwork, illustrations, patterns, compositions, graphics, photographs, renders, videos, written content, creative selections, arrangements, edits and other protectable materials are owned by their respective creator and/or held, administered or commercially used by 3D TEXTILE PATTERN S.R.L. through Designora Studio and Castle Of Gifts.

Where generative or AI-assisted tools form part of the creative process, Castle Of Gifts and Designora Studio claim rights only to the extent that the relevant human contribution, selection, arrangement, composition, editing, modification or other creative element qualifies for protection under applicable law.

We do not claim ownership of third-party material merely because it appears in, contributes to or is used during a creative process.

Third-party works, software, fonts, assets and other materials remain subject to the rights and licences of their respective owners.

When does copyright protection begin?
Copyright protection generally begins automatically when an original work is created and expressed in a form that can be perceived or reproduced. A work does not need to be sold, published or registered before copyright can exist.
Romanian copyright law also recognizes moral rights connected with the author and economic rights concerning reproduction, distribution, communication and other forms of use.
What is protected by copyright?

To the extent that the relevant material satisfies the requirements for copyright protection, protected content may include:

  • original artwork and illustrations;

  • textile and surface patterns;

  • graphic compositions;

  • original characters and visual elements;

  • 3D environments and rendered scenes;

  • photographs and digital compositions;

  • videos, animations and audio;

  • product descriptions and editorial writing;

  • packaging graphics;

  • website graphics and original interface elements;

  • promotional materials;

  • original social-media content; and

  • original selection, arrangement, editing or modification of creative material.

Protection may apply to an entire work or to original and protectable elements within it.

Not every individual idea, concept, color combination, artistic style, technique, method, factual statement or automatically generated element is necessarily protected by copyright.

Are the names and logos protected?
The names 3D TEXTILE PATTERN, Designora Studio and Castle Of Gifts, together with their logos, visual identities, slogans and other brand identifiers, may be protected by trademark law, unfair-competition law and other intellectual-property rules. Their appearance on the website does not grant permission to use them.

Purchasing and Using Products

Does buying a product give me ownership of the design?

No.

When you purchase a Castle Of Gifts product, you purchase the physical product and the ordinary rights associated with owning that physical item.

You do not purchase the copyright, source files, artwork license, trademark rights or any general right to reproduce, manufacture, distribute or commercially exploit the design.

Ownership of a physical ornament, print, gift, wrapping product or other item is separate from ownership of the intellectual property printed on or incorporated into it.

What am I allowed to do with a purchased product?

You may use or display an authentic Castle Of Gifts product for ordinary personal purposes, give the physical product to another person, photograph yourself or your surroundings with it and resell a lawfully purchased authentic physical product where applicable law permits.

These ordinary uses do not grant a right to extract the artwork, manufacture copies, reproduce the design on another product or commercially exploit the underlying intellectual property.

Nothing in this section prevents a use that applicable law expressly permits without the permission of the rights holder.

Can I resell an authentic Castle Of Gifts product?
You may generally resell an authentic physical product that you lawfully purchased, subject to applicable law. You must not represent yourself as Castle Of Gifts, Designora Studio, 3D TEXTILE PATTERN SRL, an official distributor or an authorized partner unless you have written permission.
You may not manufacture copies, attach misleading labels, remove or alter branding in a deceptive way, or use product photographs in a manner that suggests an official relationship that does not exist.
Can I copy the design onto another product?

Not without permission or another lawful basis.

You may not scan, trace, photograph, redraw, digitize, extract or otherwise reproduce protected Castle Of Gifts artwork for the purpose of printing or applying it to another garment, ornament, accessory, poster, digital product, physical product, merchandise item or commercial material without prior written permission.

This restriction does not remove any exception or limitation that applicable copyright law expressly allows.

Can I modify a design and use the modified version?

Changing colors, cropping, adding text, applying filters, redrawing portions of a work, combining it with other material or otherwise modifying a protected work does not automatically create an unrestricted right to use the result.

Depending on the circumstances, the modified work may still reproduce protectable elements of the original.

Prior written permission is therefore required unless the proposed use is otherwise permitted by applicable law.

Can I use the artwork for commercial purposes?

Not without a written commercial license or another lawful basis.

Commercial use can include reproducing artwork on products, using it in advertising, packaging, branding, promotional campaigns, client work, templates, downloadable assets, prints, merchandise or other activities intended to generate revenue or commercial value.

Purchasing a physical Castle Of Gifts product does not include a commercial license to the artwork incorporated into that product.

Nothing in this section prevents a use that applicable law expressly permits without authorization.

Website, Images and Digital Content

Can I download images or content from the website?

You may access and view Castle Of Gifts website content for ordinary personal and lawful purposes.

You may not reproduce, scrape, republish, distribute, extract, sell, commercially exploit or make substantial unauthorized use of Castle Of Gifts artwork, images, text, videos, audio, graphics, product renders or other protected content.

The technical ability to save an image, take a screenshot, inspect a webpage, access a cached copy or use an automated tool does not by itself grant permission to reuse protected material.

This section does not prevent temporary technical copies or other uses that are expressly permitted by applicable law.

Can I use Castle Of Gifts images on social media?
You may share a direct link to a Castle Of Gifts page or use the website’s official sharing tools. You may also share an official post using the platform’s native repost or share function where available.
Downloading an image and uploading it as your own post, removing credits, cropping out branding or using it to promote a business requires prior written permission.
May I use product images in a blog, article or review?

Press, journalists, reviewers, bloggers and independent creators are welcome to contact us before reproducing Castle Of Gifts product images or artwork.

Where permission is granted, the material must be used within the approved scope and any requested credit or link requirements must be followed.

Applicable copyright law may also permit limited use of protected material for purposes such as quotation, criticism, review or reporting where the relevant legal requirements are satisfied.

Permission to discuss or review a Castle Of Gifts product does not grant a general right to reproduce artwork as a standalone asset, create merchandise from it or use it in unrelated advertising or commercial materials.

Can I link to the website?
Ordinary, fair and lawful links to publicly available pages are generally welcome when they do not mislead visitors, imply endorsement, frame the website deceptively or associate Castle Of Gifts with unlawful, offensive or harmful content.
Use of logos, branded buttons, deep linking designed to bypass context, or any link presented as an official partnership requires prior written approval.
Can I use website text or product descriptions?

Castle Of Gifts product descriptions, stories, editorial content, policies and other original written material may be protected by copyright.

You may not reproduce substantial protected portions in another store, marketplace listing, catalogue, marketing campaign, dataset or other publication without permission or another lawful basis.

Limited quotation, criticism, review and other uses permitted by applicable copyright law remain unaffected.

Artificial Intelligence and Datasets

Do you use Artificial Intelligence in the creation of product artwork?

Yes, for some designs. AI-assisted tools may form part of the creative process alongside professional digital-art, 3D and design tools. The extent of AI assistance varies by design. Final creative direction, selection, editing, composition, adaptation and preparation for products are carried out through Designora Studio.

How does AI-assisted creation affect intellectual-property rights?

The use of Artificial Intelligence as part of a creative process does not automatically determine whether an entire finished design is protected by copyright.

The legal protection available depends on the particular work, applicable law and the nature and extent of the human creative contribution.

Castle Of Gifts and Designora Studio may claim copyright and other applicable rights in protectable human-created elements, including original creative direction, selection, arrangement, composition, editing, modification, written material, branding, photography, graphics and other qualifying contributions.

Where a finished product print combines AI-generated material with human-created or human-directed creative work, rights are claimed only to the extent recognized by applicable law.

Other forms of protection, including trademark rights, design rights, contractual rights and rights in individual human-created components, may apply independently of copyright.

May I use Castle Of Gifts content to train an AI system?

Castle Of Gifts and the relevant rights holders expressly reserve their rights, to the fullest extent permitted by law, in relation to text and data mining, machine learning and Artificial Intelligence training involving protected Castle Of Gifts or Designora Studio content.

No contractual permission or license is granted to copy, scrape, reproduce, extract, ingest or use protected artwork, images, product renders, text, video, audio or other content for training, fine-tuning, benchmarking or developing commercial AI or machine-learning systems.

This reservation does not remove any text-and-data-mining exception, copyright exception or other use that applicable law makes mandatory or permits notwithstanding a rights reservation.

Requests for licensed use of Castle Of Gifts content for datasets, research or AI-related purposes may be submitted in writing.

May an AI system imitate the style of Designora Studio?

An abstract artistic style, aesthetic, technique or general creative approach is not necessarily protected by copyright by itself.

However, reproducing protectable expression from particular Castle Of Gifts or Designora Studio works may infringe copyright, and the unauthorized use of names, logos, distinctive branding or misleading presentation may also raise trademark, design, unfair-competition or other legal issues.

AI-generated or human-created material must not be presented in a way that falsely suggests that it was created, authorised, endorsed or licensed by Castle Of Gifts, Designora Studio or 3D TEXTILE PATTERN S.R.L.

We reserve all rights available under applicable copyright, trademark, design, unfair-competition and other laws.

Customer and Third-Party Content

What rules apply if I send you text, photographs or artwork?
Any content you submit must be yours or lawfully available for you to use. You must have permission from all relevant rights holders and from identifiable people where required. You must not submit content that infringes copyright, trademarks, privacy, publicity rights or other rights, or that is unlawful, defamatory, hateful, deceptive or harmful.
Do I keep ownership of content I submit?

Yes. You retain the rights that you already hold in content you submit to Castle Of Gifts.

By submitting content in connection with an order, customer-service request, complaint, review, collaboration, promotion or other service, you grant 3D TEXTILE PATTERN S.R.L. and the service providers reasonably involved a limited, non-exclusive permission to process and use that content only to the extent necessary for the relevant purpose.

For example, submitted content may be used to:

  • process or fulfil a request;

  • investigate a product or delivery problem;

  • communicate with a production or service partner; or

  • publish material where you have expressly agreed to publication.

Submitting content does not transfer ownership of that content to Castle Of Gifts unless a separate written agreement expressly provides otherwise.

Can Castle Of Gifts remove submitted content?
Yes. We may reject, remove, restrict or preserve submitted content where reasonably necessary to protect rights, comply with law, enforce our rules, investigate a complaint, protect users or maintain the quality and integrity of the website.
What happens if submitted content infringes someone else’s rights?

ou must not knowingly submit material that you do not have the right to use.

Where submitted content may infringe another person's copyright, trademark, privacy, publicity or other rights, Castle Of Gifts may suspend the relevant request, restrict or remove the material, seek additional information, preserve relevant evidence or take another reasonable action permitted by law.

The person who submitted the material may be responsible for unlawful use where applicable law provides.

Permissions, Licenses and Collaborations

Can I request permission to use artwork or website content?

Yes.

Send a clear written request to info@designorastudio.com explaining:

  • which work you want to use;

  • where it will appear;

  • the intended purpose and audience;

  • the territory;

  • the duration;

  • the format;

  • whether the use is commercial; and

  • whether you propose to modify the work.

No license or permission exists unless it has been granted in writing.

Silence, a social-media interaction, purchase of a product, receipt of a sample or technical access to a file does not by itself constitute permission to reproduce or commercially use protected material.

Do you offer commercial licenses?
Commercial licenses may be considered case by case. Availability, scope, territory, duration, exclusivity, media, fees, credit requirements and approval rights will be agreed in writing. Designora Studio is not obliged to approve a request.
Can I collaborate with Designora Studio or Castle Of Gifts?
Collaboration proposals are welcome when they are clear, respectful and relevant. A discussion, sample, mood board, quotation or draft does not create a partnership, license or transfer of rights unless a written agreement says so.
Can I commission exclusive artwork?
Castle Of Gifts does not create exclusive commissioned artwork.

Infringement, Counterfeits and Reporting

What is copyright infringement?

Copyright infringement can include unauthorized reproduction, distribution, publication, adaptation, upload, communication, sale or other use of protected material where the rights holder's permission is legally required.

Whether a particular use constitutes infringement depends on the work, the particular use, applicable copyright exceptions and the law governing the situation.

Not every resemblance, reference, quotation or use of protected material automatically constitutes infringement.

What is counterfeit merchandise?
Counterfeit merchandise includes unauthorized products that copy or misuse Castle Of Gifts or Designora Studio artwork, names, logos, labels, packaging or other protected elements in a way that falsely suggests authenticity or approval.
How can I report suspected infringement or counterfeit products?

Please email info@designorastudio.com and include, where available:

  • your name and contact information;

  • a description of the relevant Castle Of Gifts or Designora Studio work or brand;

  • the location of the suspected infringement;

  • links, screenshots or photographs;

  • the reason you believe the use is unauthorized; and

  • any other information that may help us investigate.

Do not place yourself at risk or purchase suspicious products solely to obtain evidence.

What should I do if I believe Castle Of Gifts content infringes my rights?

If you believe material published by Castle Of Gifts infringes your intellectual-property rights, contact info@designorastudio.com.

Please provide enough information to identify:

  • the work or right you claim;

  • the material you believe is infringing;

  • its location on the Website;

  • your relationship to the relevant rights;

  • the reason you believe the use is unauthorized; and

  • the action you are requesting.

We may ask for additional information reasonably necessary to verify the claim.

Good-faith notices will be reviewed and appropriate action will be taken where warranted.

Can you remove or disable infringing content?
Where appropriate, we may remove content, disable access, suspend a listing, contact a service provider, preserve evidence, send a legal notice or use another remedy available under contract or law. The response will depend on the seriousness, evidence and legal context.

Legal Position and Contact

Which law applies to these intellectual-property rules?
These store rules are written for 3D TEXTILE PATTERN SRL, a company established in Romania. Romanian law and applicable European Union law may apply, together with mandatory laws in other jurisdictions where relevant. Copyright and other rights can also be protected internationally through treaties and local laws.
Do these rules limit rights granted by law?
No. Nothing on this page removes a right, exception or limitation that cannot lawfully be excluded. Uses such as quotation, criticism, review, education, parody or news reporting may be permitted only where the exact legal conditions are satisfied. Calling a use “fair use,” “inspiration,” “non-profit” or “educational” does not automatically make it lawful.
Can this page be updated?
Yes. We may update this page to reflect changes in our creative work, services, licenses, technology, business operations or applicable law. The version published on the website will be the current version.
